1) Scope

You are currently connected to the www.localers.com website (the "Site"), the reservations Site of the company Travel Like a Local. In accordance with French law, we invite you to review the present Terms and Conditions of Sale as well as any specific conditions specified on the pages of the Site, governing your use of our Site.

Please note that your use of our Site constitutes your agreement to follow and be bound by these terms. If you do not agree to these Terms and Conditions of Sale, please do not use this Site or make reservations on it. Localers shall be entitled to terminate the Terms and Conditions of Sale immediately in case of failure by the Client t3o comply with any disposition of the Terms and Conditions. In case of termination of the Terms and Conditions by Localers, the Client shall not be entitled to any compensation nor the possibility of a refund of any fees incurred.

The Terms and Conditions of Sale define the conditions of sale of Services (as defined below) on the Site edited by the company Travel like a Local (see Legal Mentions) for all Clients.

Definition

Client refers to all persons, physical or moral having subscribed to one of our paid services in conjunction with Localers and having paid the agreed price.

User refers to Site visitors and users

“Fast Check Out” refers to the possibility to reserve a service proposed by Localers using an electronic mail address (e-mail), without the creation of a personal member’s account.

Service refers to a visit, walk, excursion, private or in group, as advertised on the Site.

Profile refers to all the information provided by the Traveler/Client and the manner of its collation on the site

Site refers to the website www.localers.com

Tour refers to all paid services proposed by Localers, (visits, walks, activities, excursions), that last less than twenty-four (24) hours.

Voucher refers to a receipt of purchase exchangeable against a service. It is provided immediately after the reservation of a service that the client has paid for.

By using our Site, you agree to respect the Terms and Conditions, which take effect immediately. Any reservation confirmed on the Site means the full and complete acceptance of these general Terms and Conditions. They are the only applicable conditions.

Localers reserves the right to update or modify these Terms and Conditions of sale at any time without prior notice. Your use of the Site following any such changes constitutes your agreement to follow and be bound by the modified Terms and Conditions of sale. For this reason, we encourage you to review these Terms and Conditions of sale regularly.

2) Presentation of Localers

The Site sells tours and activities in Europe (are hereafter referred to as Services). Indeed, Localers provides services for tourists, particularly excursions, tours, visits, recreational activities and gastronomical and cultural activities.


3) Terms of Access of Services by Localers

This site is available for your personal use free of charge (with the exception of your personal internet connection charges), provided the conditions herein described are accepted. Your use of the site constitutes your complete acceptation of the Terms and Conditions .

You agree to only use the Site for legal purposes or for legitimate requests to reserve the Services proposed. All fraudulent use of the Site is strictly prohibited.

3.1 Booking a service

The process of booking a Service on the Site is as follows.

- The user chooses a tour

- The user chooses the number of participants who will be present on the tour, as well as the desired date(s) according to availability.

- The full payment will be made online with our secure payment system.

Reservations are considered effective as soon as the client receives the confirmation voucher and not the payment receipt sent by Localers. This confirmation voucher is the only proof of payment for the service. This voucher should thus be kept by the client who must present it at the departure of the tour. It is the only proof of payment/identification that Localers will accept.

Once the payment is authorized by the client’s bank and that the service is confirmed by Localers, a confirmation voucher will be sent to the client. This confirmation voucher contains all the details of the purchase (reservation status, tour name, time, number of participants, meeting point).

In case the voucher is lost, the client must contact Localers to be issued a new voucher.

3.2 Making changes to Bookings


Changing Tour dates

The Client may change his reservation up until 48 hours before the start of the Service.

In order to apply changes to the reservation, the Client should inform Localers at booking@localers.com. Localers will respond to the demand as soon as possible in order to find a new time and/or date. If Localers is notified about the change in time and cannot accommodate it, Localers will refund the price of the purchase.

For all of the tours including tickets to the Versailles Palace, the Eiffel Tower, Private Access to the Catacombs, Vatican Museums and/or Sainte-Chapelle Concert, a 10% fee will be applied to change the date.

Changing Number of Participants

The Client may change the number of participants up until 48 hours before the start of the Service.

In case the client wants to add participants, this change is only possible if the capacity of the tour allows it. The client should address all demands to change his reservation by email by writing to booking@localers.com.

3.3 Canceling a Booking

The Client may cancel his entire reservation up until 48 hours before the start of the Service.

For all of the tours including tickets to the Versailles Palace, the Eiffel Tower, Private Access to the Catacombs, Vatican Museums and/or Sainte-Chapelle Concert, a 10% fee will be applied to cancel the Service.

Without a 48 hours’ notice, Localers will not reimburse the purchase and keep 100% of the reservation.

All cancellation requests should be made by mail to booking@localers.com and should include the reservation number, the name of the client, as well as the date. Localers will process the demand as soon as possible.

Any interruption of the tour or activity during the Service, on the part of the client, will not be subject to reimbursement.

All processed reservations on the site implicate the full and complete acceptance of the Terms and Conditions of sale as well as the payment in full of the reservation price.

3.4 Ceding your booking to another person

After a reservation is completed, someone else may participate in the tour in your place free of charge. All sale of a reservation by a person other than Localers is strictly prohibited and will not be recognized as legitimate by Localers.

The assignor(s) must signal the ceding of the reservation via email to Localers at least 48 hours before the start of the Service, by indicating the precise name(s) and identification information of the assignee and beneficiaries. The beneficiaries must fulfill the same criteria as the assignor in order to take part in the tour.

3.5 Late Arrivals

For group tours, any participant arriving more than 15 minutes after the departure time will see his tour canceled and therefore non refundable, regardless of the reason for the late arrival.

For private tours, any participant arriving more than 30 minutes after the departure time will see his tour canceled and therefore non refundable, regardless of the reason for the late arrival.

This does not apply to any Versailles Palace and Catacombs tours. For these services, late arrivals will not be permitted, regardless of the reason for the late arrival.

4) Prices

The prices mentioned on this Site are stated in Euro (€). Unless otherwise indicated, the prices include French V.A.T.

Service prices are subject to modification without notice and are not guaranteed until the client receives a confirmation voucher. Prices vary according to the number of people per booking.

Specials offers indicated on the site, and only valid for a limited period of time and include a discount comprised between 5 to 20% off the regular price. They are subject to change at anytime and are not guaranteed until the client receives a confirmation voucher.

5) Payment

All payments must be done at the time of booking to validate a reservation.

There is no additional cost at the time of booking. We always charge the full amount of the reservation in Euro (€). The client assumes responsibility for any bank fees incurred in connection with payments, including but not limited to bank or currency fees as well as currency fluctuations.

6) Intelectual Property

The Localers site (including all graphics, logos, names, brand names, appointments, tabs, functions, images, sounds, texts....of the Localers site) is the exclusive property of Localers. Localers is a registered trademark.

All partial or complete reproduction of the Localers site is strictly prohibited. All unauthorized reproduction constitutes an infringement subject to legal consequences.

- The contents of the Localers site are the exclusive property of Localers.

- All users have the right to access the contents.

- Content downloaded by a client from the Localers site for off-line use for example, remains the exclusive property of Localers.

- All re-use of the contents by the user for commercial or promotional purposes is strictly prohibited.

- Any violation of the intellectual property rights of the Localers site may be punished by the immediate deactivation of the implicated user’s account.

- Any adaptation or exploitation of the contents by the user are exclusively his own responsibility.

7) Client Responsibility

All Localers tours are covered by a professional cover insurance as required by law, which covers bodily, material, and immaterial harm which could befall the clients of a tour following shortcomings or failure of Localers’ services. The client is encouraged to consult his/her insurer for all complementary coverage from which he/she wishes to benefit.

8) Localers Liability

Localers shall not be liable for any damages, material or immaterial, direct or indirect, that may arise from , or due to, the fault of the Client (i.e. ignoring security information given by the guide) during an excursion or service provided by Localers.
The client may not request reimbursement or refunds if cancellation of a tour is the result of any act, event or circumstances not reasonably within the control of Localers, including but not limited to any war, terrorism, civil unrest, strikes, severe weather, and other extraordinary circumstances.

9) Personal Data

The subscribed user is informed that his/her personal information entered on the site by means of forms are saved by the Localers host server in a way which complies with the law entitled "Informatique et Libertés" from January the 6th of 1978.

The electronic file containing the traveller’s information has also been transmitted to the "CNIL".

The personal information of the user provided during the booking process will only ever be used by Localers in order to satisfy the functional needs of the Localers services.

Localers does not rent, sell or distribute any part of user information collected to any third party organization. All credit card information is kept confidential and safeguarded by our secure server.

When booking services on the website, Localers includes the user’s email address in Localers newsletter so that the user can receive updates and offers. At any point, the user can unsubscribe to this newsletter.

10) Cookie

The user/client is informed that during his/her visits on the site Localers, that a cookie may be installed automatically on their web browser. The user has the right to access this cookie, to withdraw it and make modifications of personal information that has been communicated by the cookie by following the steps described below. To delete cookies, the user must follow the instructions as described by their web browser (found in the tab “Help”)

11) Duration/Suspension/Cancelation

The user/client will be subscribed to the Localers site for an undefined duration. The user may deactivate his/her account at any time, as described in article 3.2.4 as described above. Localers reserves the right to temporarily or permanently suspend or prohibit access to the Localers site to any user/client in case of a violation of the present terms and conditions on behalf of the user.

12) Dispute

The present Terms and Conditions adhere to French law. In the case of a dispute related to the interpretation, application, termination, or nullity of the present terms and conditions, only courts of competent jurisdiction pertaining to the locality of company headquarters (Paris) will be considered for purposes of litigation, including in the instance of a procedure out of court, regardless of the plurality of defenders.

The company Travel Like A Local is referred hereafter under the name Localers.

Preamble

The present Terms and Conditions define the stipulations of access of the services provided by the site www.localers.com, henceforth referred to as « Localers » and the terms of use of the service by the user or client.

All access and/or use of the site Localers implicates the conscious compliance with and full respect of the Terms of Use in their entirety. Therefore, the terms of use represent a contract between Localers and the user or client. If you disagree with any part of the Terms and Conditions, you may not use Localers in any way.

By accepting the present Terms and Conditions, you are consenting to the contract between Localers and, you, the client. Therefore, any violation, infringement, or non-compliance with the various conditions established in the present Terms and Conditions automatically invalidates the contract and voids all booked/purchased services, without notice or refunds and without the possibility of reimbursement of the expenses involved.

Localers reserves the right to modify the present Terms and Conditions at any time, all modification of the Terms and Conditions will be subject of an notice that will appear on the site. . All use of the Localers site following such modifications assumes conscious acceptance of the Terms and Conditions as they appear.

The Site sells a selection of tours and activities throughout Europe (are hereafter referred to as Services). Indeed, Localers provides services for tourists, particularly excursions, tours, visits, recreational activities and gastronomical and cultural activities.

3) Condition of access to the site Localers

All users can access the Localers site

- Any user with an internet connection can access the Localers site at no cost.

- Any cost to the Localers site, including but not limited to, equipment and internet connection are the responsibility of the user.

- Any user who is not an account holder on the Localers site has only the right to access the data and information available on the site.

- The user does not have the right to download and/or modify the site’s content. Any violation will incur legal consequences.

By booking a service offered on the Localers site, the client accepts the present terms and conditions and certifies that:

1. The client is of legal age and is capable of entering into a contract, thereby agreeing to make any documents necessary to attest to their physical/mental fitness, thus allowing them to participate in the chosen service available. Localers reserves the right to request these documents for all clients, if deemed necessary.

2. The client is sufficiently insured to engage in the activities necessary to participate in a service offered by Localers.

4) Intellectual Property

The Localers site (including all graphics, logos, names, brand names, appointments, tabs, functions, images, sounds, texts....of the Localers site) is the exclusive property of Localers. Localers is a registered trademark.

5) Disclaimer

Localers is not liable for any damages, material or immaterial, direct or indirect, which could result from the misuse of the services offered on the Localers site. The information diffused on the Localers site stems from reliable sources. However, Localers does not guarantee the exactitude or pertinence of this information to the voyager. Therefore, the use of information and contents available on the Localers site and any consequences are the sole responsibility of the user.

6) Availability of the site Localers

The Localers site is accessible 24 hours a day, seven days a week with the exception of programmed maintenance interruptions and incidents beyond the control of Localers. Localers reserves the right to interrupt, or modify the access to the Localers site, without obligation to inform the user/client, for any reason deemed necessary by Localers. This interruption does not result in a right to compensation.

Localers will do everything within its means to assure normal access to the Localers site, but may not be held liable in the event of site or server malfunction or any other event which may prevent or limit access to the Localers site.

Localers is not liable in the event of pirating of the Localers site. The user declares acceptance of the inherent characteristics and limits of the internet. Localers may terminate at any time the exploitation of the site. This does not grant the user a right to any compensation—monetary or otherwise. Localers reserves the right to modify the features of the Localers site (by means of addition, deletion, or substitution) to satisfy its technical and legal arrangements.

7) Cookies

A cookie may be installed automatically on the user's web browser. The user has the right to access this cookie, withdraw it and make modifications of personal information that have been communicated. Localers privacy policy

Protecting your personal data is of the essence to LOCALERS.

We therefore want to explain in a clear and transparent way how and why we collect, process, store and use your personal data.

We shall also present your rights and monitoring tools that you may use for your personal data.

That is the purpose of this Privacy Policy, which is explained in more detail hereafter.

Which information do we collect?

We collect the surname and first name of the main passenger of the booked activity, their telephone number, email address and language chosen for the activity.

When you order a product on our website, we shall ask you, in addition to the above information, for information on your means of payment.

Children’s personal data on our website

Our website is not meant to be used by children under the age of 18, and we shall never knowingly collect information on any person younger than 18.

How and for what purpose are your personal data used?

Your personal information is collected directly, in order to process your order, and to inform you of important changes if necessary.

These data will also be used for statistical purposes or for surveys, to improve the website and services that we offer you.

We may also at any time send you information on products, promotions and special offers at Localers.

Which information do we share with third parties?

Mainly, we only share your personal data within our company.

Right to appeal to a supervisory authority

If you suspect that Localers is using your personal data in an inappropriate manner, you may contact us. You also have the right to file a complaint with the supervising authority.

Changing our Privacy Policy

Laws and practices change over time. Should we decide to update our privacy policy, we shall publish the changes on our website. If we change the way we process your personal data in any substantial way, we shall notify you in advance, or where required by law, ask your permission before implementing these changes. We sincerely advise you to read our privacy policy and to check regularly if changes have been made to it. The privacy policy was last changed in May 2018.
